Data Protection Notice

This notice is issued under Article 10 of Turkish Law No. 6698 on the Protection of Personal Data (“KVKK”) to inform data subjects about the purposes and legal grounds on which personal data submitted through our website is processed, and to whom it may be transferred.

1. Data Controller

2. Personal Data Processed

Only the data you enter into the contact and quotation forms on our website is processed:

• Identity data: first name and surname
• Contact data: e-mail address, telephone number
• Customer transaction data: the name of the company you represent, information about the product or service you request, and any other information you include in your message

3. Purposes of Processing

• Responding to your requests, questions and complaints
• Preparing and sending you price quotations for our products and services
• Conducting pre-contractual negotiations and concluding a contract
• Carrying out sales and after-sales support processes
• Fulfilling our legal obligations and using the data as evidence in any dispute

4. Legal Grounds

Your personal data is processed under Article 5/2 of the KVKK without requiring explicit consent, on the following grounds:

• Art. 5/2-c: processing is necessary for the conclusion or performance of a contract, provided it is directly related to the parties to that contract
• Art. 5/2-ç: processing is mandatory for the data controller to fulfil a legal obligation
• Art. 5/2-e: processing is mandatory for the establishment, exercise or protection of a right
• Art. 5/2-f: processing is necessary for the legitimate interests of the data controller, provided it does not harm the fundamental rights and freedoms of the data subject

Any processing outside this scope is carried out solely on the basis of your explicit consent.

5. Transfer of Personal Data

Limited to the purposes above, your personal data may be transferred to:

• Our suppliers of information technology infrastructure, server hosting and e-mail services
• Public authorities and judicial bodies legally authorised to request it, to the extent required by law
• Our legal and financial advisers, to the extent necessary

International transfer: our contact page embeds a Google Maps window showing our location. When it is displayed, your browser connects directly to Google’s servers; your IP address and browser information may be processed by Google and transferred abroad. That processing is governed by Google’s own privacy policy. If you prefer not to load the map, you may contact us directly by telephone or e-mail.

6. Method of Collection

Your personal data is collected electronically, by non-fully-automated means, when you complete and submit the contact or quotation forms on our website.

7. Retention Period

Your personal data is retained for as long as necessary for the purpose of processing and, in any event, for the statutory limitation and retention periods prescribed by applicable legislation. Once those periods expire, your data is deleted, destroyed or anonymised.

8. Rights of the Data Subject

Under Article 11 of the KVKK you may apply to the data controller and request to:

1. Learn whether your personal data is being processed
2. Request information if your personal data has been processed
3. Learn the purpose of processing and whether the data is used in accordance with that purpose
4. Know the third parties in Türkiye or abroad to whom your personal data has been transferred
5. Request correction of your personal data if it has been processed incompletely or inaccurately
6. Request deletion or destruction of your personal data under the conditions set out in Article 7 of the KVKK
7. Request that correction, deletion and destruction operations be notified to third parties to whom the data was transferred
8. Object to a result adverse to you arising from the analysis of your data exclusively by automated systems
9. Claim compensation for damage arising from unlawful processing of your personal data

9. How to Apply

You may submit your requests in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller:

• In writing, by signed petition, to Battalgazi Mahallesi, Bostancı Sokak No:1 B1-33, 34935 Sultanbeyli / İstanbul
• By secure electronic signature or mobile signature
• From the e-mail address you have previously notified to us and which is registered in our systems, to info@sumergaz.com

Your application must state your name, surname and signature; your Turkish ID number if you are a Turkish citizen; your address for service; your registered e-mail address and telephone number, if any; and the subject of your request.

Your request will be concluded free of charge as soon as possible and within thirty days at the latest. Where the process incurs an additional cost, a fee may be charged in accordance with the tariff set by the Personal Data Protection Board.

10. Advertising and Conversion Measurement

A Google Ads measurement tag provided by Google LLC runs on every page of our website. Because of this tag, your browser connects to Google’s servers when a page is viewed; as a result of that connection your IP address, browser and device information and the address of the page you are viewing may be transferred to Google and processed abroad.

Unless you choose “Accept” in the cookie banner, the tag operates in restricted mode: no advertising cookie is written to your browser, advertising identifiers are redacted, and no personalised advertising takes place.

If you choose “Accept”, advertising cookies are set on the basis of your explicit consent (Article 5/1 of the KVKK); which advertisement brought you to our site, and interactions such as submitting the quotation form or clicking the WhatsApp or telephone link, are recorded as conversions and may be used for remarketing.

Retention: if you consent, the advertising cookies set on our domain are retained for 90 days by default. See our Cookie Policy for details.

Withdrawing consent: you may withdraw consent at any time via the “Cookie preferences” link at the bottom of every page. The advertising cookies on our domain are then deleted and the tag returns to restricted mode. Withdrawal does not affect the lawfulness of processing carried out before it.
